Official Rules
NO PURCHASE NECESSARY TO ENTER, PLAY, OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
ELIGIBILITY: The Indian Motorcycle Project Chieftain Sweepstakes (the “Sweepstakes”) is open only to eligible individuals who, as of the date of entry, are legal residents of and residing in the contiguous 48 United States (including the District of Columbia, excluding Alaska and Hawaii) or a legal resident of Canada (excluding Quebec). Employees of Polaris Industries Inc., (“Polaris” and “Sponsor”), GMR Marketing LLC (“GMR” and “Administrator”), and their respective parent companies, affiliates, dealerships, promotion and other vendor agencies involved in this Sweepstakes (the “Released Parties”), as well as the immediate family members (spouse, parents, siblings and children) and household members of each such employee, are not eligible to enter or win. Void for residents of Alaska, Hawaii, Quebec and where prohibited or restricted by law. Sweepstakes is subject to all federal, state, provincial, and local laws and regulations.
SWEEPSTAKES TIMING: The Sweepstakes will take place between 12:01 p.m. Central Time (“CT”) on February 1, 2017 and 11:59 p.m. CT on February 15, 2017 (the “Sweepstakes Period”).
HOW TO ENTER: To enter the Sweepstakes, for U.S residents, visit http://www.indianmotorcycle.com/en-us/project-chieftain, for Canada residents, visit http://www.indianmotorcycle.com/en-ca/project-chieftain, submit your vote for one (1) custom built Indian Chieftain Motorcycle listed (the “Vote”) by selecting the Indian Chieftain Motorcycle model you like best during the Sweepstakes Period. Complete the Official Online Entry Form, including the required entry fields, and acceptance of Official Rules and Sponsor’s Privacy Policy to receive one (1) entry into the Sweepstakes during the Sweepstakes Period. Limit one (1) entry per person/authorized e-mail account holder per day during the Sweepstakes Period. A “day” is defined as a twenty-four (24) hour time period beginning at 12:00:00 a.m. (midnight) CT and ending at the following 11:59:59 p.m. CT.
Any attempt by any person to submit more than the stated number of entries by using multiple/different e-mail addresses/accounts or any other methods will void that person’s Sweepstakes entries and that person will be disqualified. Each eligible entrant must enter using one (1) e-mail address and must be the authorized e-mail account holder. Sweepstakes entries must be submitted during the Sweepstakes Period in strict accordance with the instructions and restrictions in these Official Rules. Entries may not be made jointly or by any group and may only be made by an individual. Proof of submitting an entry other than as detailed above (such as a printed or copied confirmation screen or message) does not constitute actual receipt of the entry for purposes of this Sweepstakes. All entries become the sole property of the Sponsor and receipt of entries will not be acknowledged or returned. Facsimiles, mechanical reproductions, alterations, garbled, incomplete, misdirected, lost, late, forged entries, or entries generated by a macro, bot, or other automated means will not be accepted and are void. Those who do not follow all of the instructions, provide the required information in their entry, or abide by these Official Rules will be disqualified.
DETERMINATION AND NOTIFICATION OF PRIZE WINNER: The potential Grand Prize winner will be selected in a random drawing from among all eligible entries received during the Sweepstakes Period on or about February 22, 2017 by the Administrator whose decisions on all matters relating the Sweepstakes are final. The potential Grand Prize winner will be notified on or about February 23, 2017 via e-mail to the e-mail address provided on the Official Entry Form. The potential Grand Prize winner must respond to the email notification within 48 hours of attempted notification. If the potential Grand Prize winner does not respond to email notification within 48 hours of attempted notification, the prize will be forfeited and a potential alternate Grand Prize winner will be selected from the remaining eligible entries submitted, time permitting. The potential Grand Prize winner must complete, sign, and return an Affidavit of Eligibility, Mutually-Acceptable Liability Release, and Publicity Release (where permitted by law), and the appropriate tax documents if a U.S. resident, or the Grand Prize winner must complete, sign, and return a Declaration of Eligibility and a Release of Liability and must correctly answer a time-based mathematical skill-testing question without assistance of any kind, if a Canadian resident, (the “Documents”), within five (5) calendar days of delivery of the Documents, or the Grand Prize will be forfeited in its entirety and an alternate winner may be selected. Further proof or verification of identity and qualifications may be required along with a background and/or records check. Failure to oblige will result in disqualification. Sponsor reserves the right, in its sole discretion, to disqualify a potential Grand Prize winner for any of the following reasons: (a) non-compliance with these Official Rules; (b) in the event that a Grand Prize notification is returned as undeliverable or prize is declined; (c) information showing that the entry was defective or failed to comply with these Official Rules and randomly select an alternate potential Grand Prize winner, time permitting. Return of any prize or prize notification as undeliverable or failure to accept any prize within the specified time period may, in the Sponsor’s sole discretion, result in disqualification and forfeiture of prize. Upon prize forfeiture, no compensation will be given. The Grand Prize will be fulfilled approximately 10-12 weeks following winner confirmation.Grand Prize winner must take delivery of the Grand Prize at an Indian Motorcycle dealer nearest to where they reside within fourteen (14) days of notification of availability or prize will be forfeited. If any prize is returned as undeliverable, original winner will forfeit prize in its entirety and an alternate winner may be selected, time permitting.
PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”): Odds of winning depend on the number of eligible entries received.
One (1) Grand Prize: One (1) Indian Chieftain Motorcycle (model, color, and year to be selected at the sole discretion of the Sponsor). Grand Prize motorcycle will be delivered in “as is” condition; any upgrades and options are at the sole expense of the winner. Motorcycle awarded to a California, Massachusetts, New York, or Vermont resident will include required emissions equipment, if applicable. Winner must take delivery of the Grand Prize motorcycle at an Indian Motorcycle dealer or other location as designated by Sponsor. The Grand Prize does not include any additional costs beyond delivery to the Indian Motorcycle dealer. Winner must show evidence of insurance and a valid license to operate a motorcycle in order to accept delivery, or prize will not be awarded and an alternate winner may be chosen. Winner is responsible for the costs of any vehicle options beyond the ARV as may be agreed to between winner and the Indian Motorcycle dealer or other location as designated by the Sponsor, at which vehicle will be delivered.
The Grand Prize motorcycle will come with a standard factory warranty. Any and all guarantees and warranties for the Grand Prize are subject to Indian Motorcycle’s warranty and terms and conditions, and the winner agrees to look solely to Indian Motorcycles for any warranty or guarantee claim. SPONSOR MAKES NO OTHER WARRANTIES, EXPRESS OR IMPLIED, AS TO THE QUALITY OF CONDITION OF THE MOTORCYCLE AND EXPRESSLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Prizes consist only of items specifically listed as part of the prize. Prizes are non-transferable and no substitution or cash equivalent is allowed except in Sponsor’s sole discretion. Sponsor reserves the right to substitute prize of the same approximate retail value. Sponsor will issue an IRS Form 1099-MISC to the winner, if the winner is a U.S. resident. ARV is as of the time the Official Rules were printed, and the value of the prize may fluctuate. The winner is not entitled to any difference between the ARV and the actual value of the prize at the time the prize is awarded.
The Grand Prize winner will receive a single cash payment in the form of a corporate check, if the winner is a U.S. resident. The single cash payment will be based on a 34% tax rate of the final Grand Prize value. The single cash payment is intended to assist with any federal or state tax obligations related to the Grand Prize, but in no event will the single cash payment exceed $12,363.12 USD for the Grand Prize. All additional taxes, fees, surcharges and costs associated with the prize, are the sole responsibility of the winner. The Grand Prize winner is responsible for all federal, state, and local income taxes and other taxes associated with the prize. The Sponsor will comply with all tax reporting requirements.
If the winner is a U.S. resident, the total ARV of the Grand Prize is $36,362.12 USD.
If the winner is a Canadian resident, the total ARV of the Grand Prize is $23,999 USD.
PUBLICITY AUTHORIZATION: Except where prohibited, entry into the Sweepstakes and/or acceptance of a prize constitutes consent that each entrant’s and Prize winner’s name, image, likeness, voice, address (city and state/province), statement(s) about Sponsor and/or the Sweepstakes, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent.
GENERAL CONDITIONS: If for any reason the Sweepstakes, including the online portion, is not capable of running as planned, including disruptions caused by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, provincial or local government law, order or regulation, order of any court or jurisdiction, or any other cause that corrupts, affects or compromises the administration, security, fairness, integrity, proper conduct or intended play of the Sweepstakes (each a “Force Majeure” event), Sponsor reserves the right at its sole discretion to disqualify any individual Sponsor deems responsible and Sponsor further reserves the right to cancel or terminate the Sweepstakes (or portion thereof). In the event the Sweepstakes is cancelled or terminated as a result of a Force Majeure event, Sponsor reserves the right to select the potential winners in a random drawing from among all eligible entries received up to time of such event. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications failure, theft, destruction or unauthorized access to, or alteration of, entries, including any erroneous appearance of qualification for a prize. Sponsor is not responsible for any problem or technical malfunction of any telephone network or lines, computer online systems, cable, satellite, servers, network or Internet service provider (ISP), computer equipment, software, failure of any entry to be received by Sponsor due to technical problem or traffic, congestion on the internet or at any web site, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Sweepstakes entries generated by a script, macro or other mechanical or automated means and entries made by any means which subvert the entry process are ineligible and will be disqualified. In the event of dispute as to the identity or eligibility of a winner based on an email account, the winning entry will be declared made by the “Authorized Account Holder” email account submitted at the time of the entry. The Authorized Account Holder is the natural person who is assigned to the email address.
ADDITIONAL TERMS: By entering, entrant agrees to accept and abide by these Official Rules and agrees that any dispute with regard to the conduct of this Sweepstakes, rule interpretation or award of prize, shall be resolved by GMR and/or Sponsor, whose decision shall be binding and final. By entering, entrant agrees to be notified using the contact information provided in the entrant’s Entry by the Sponsor and/or GMR for the purposes of the administration of this Sweepstakes. By participating, entrant agrees to release and hold harmless the Released Parties from any injury, loss or damage to person, including death or property damage due in-whole or in-part, directly or indirectly to the acceptance, use, or misuse of a prize (including any travel/activity related thereto), participation in any Sweepstakes-related activity, or participation in the Sweepstakes. Sponsor is not responsible for any typographical, printing, or other error in the printing of these Official Rules, or any network, computer, mechanical, electronic, human or other errors or problems in connection with this Sweepstakes, including, without limitation, any errors or problems which may occur in connection with the administration of the Sweepstakes, the processing of entries or emails, or in the announcement of prizes, including such error that may give an erroneous indication that a prize has been won. All entries become the property of the Sponsor and are not returnable.
DISPUTES: THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF THE STATE OF MINNESOTA WITHOUT RESPECT TO CONFLICT-OF-LAW DOCTRINES. As a condition of participating in this Sweepstakes, each participant agrees that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this sweepstakes shall be resolved individually, without resort to any form of class action, exclusively before a court located in Minnesota having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this sweepstakes), and participant further waives all rights to have damages multiplied or increased.
